Ripple defendants answers to the SEC’s first amended complaint have now been filed
According to Ripple and SEC litigation attorney James K. Filan, the responses of Ripple defendants Brad Garlinghouse and Chris Larsen to the SEC’s First Amendment lawsuit have now been filed.
Also, we’re still waiting for decisions on the SEC’s Motion for Partial Reconsideration, the Defendants’ Motion to Strike the Supplemental Expert Report, the Defendants’ Motion to Compel Turnover of the Estabrook notes, and the decision on the SEC’s proposed redactions.

Here’s a possible timeline of events as Ripple defendants file answers to SEC
Defense attorney Filan then shared a possible timeline of events as the case progressed.
Ripple is still awaiting a court ruling, according to defense attorneys. Currently, four judicial decisions are pending: the decision on SEC Motion for Partial Review, Defendant’s Motion to Repeal the Additional Expert Report, Defendant’s Motion to Dismiss required rotation of the Notes of Incorporation, and the decision on proposed transactions by the SEC.
According to previous updates shared by defense attorneys, the submission of answers by Individual Defendants remains the triggering event. He added that once answers are filed, the two-week clock for submitting the SEC’s position on the findings and proposed General Scheduling Order begins to tick.
The SEC is expected to notify the court of its position on whether to request any additional findings within one week of submitting the Individual Defendants’ responses. The SEC and Ripple have also been ordered to meet and discuss a schedule of briefings for summary judgment motions.
No later than one week after the SEC submits its findings, the parties must submit a joint schedule of proposals for court approval.
