Detail about the operator of Australia’s ‘PayID’ payments network is suing Ripple Labs over its use of ‘PayID’ branding

At the moment, Ripple is facing a lawsuit from New Payments Platform Australia (NPPA) – an important banking group in Australia. While the court documents have yet to be made public, the lawsuit is allegedly alleging infringement of the intellectual property rights associated with the PayID payment standard’s trademark from Ripple.

According to information from technology journalist Rohan Pearce on August 24, he shared a screenshot showing that NPP Australia Limited, the operator of the Australian interbank payments network Pay ID, has applied. Australian Federal Court against Ripple Labs Inc.

NPPA’s payment platform is currently used by more than 60 Australian banks and allows users to send and receive money instantly 24/7 by email address or phone number. Most domestic cryptocurrency exchanges that accept fiat through PayID include Independent Reserve and BTC Markets, two members of Ripple’s Open Payment Alliance. This shows that Ripple is already aware of the Australian brand PayID.

This lawsuit seems unsatisfactory because the NPPA secured the trademark rights to Pay ID (with space) in March 2017. Then, they also filed for trademark registration for ‘PayID’ (without the spa) in October 2017. However, the ‘PayID’ application expired in April 2018, and no other trademarks were registered.

NPPA is jointly owned by 13 banks, including major institutions ANZ, HSBC, Citi, and Reserve Bank of Australia.

Ripple Labs applied for the two trademarks ‘PayID’ with the US Patent and Trademark Office on June 17, 2020. NPPA filed another application for the same trademark in Australia on July 24, 2020.

The court held an online dialogue hearing on August 20, and a case management hearing took place on the morning of August 26.

Ripple announced PayID in June when the company launched its Open Payments alliance, with PayID being seen as a means of enhancing interoperability between more than 40 corporate and nonprofit alliance members.

Ripple describes PayID has broken countless globally blocked payment networks, claiming that PayID will make transferring money as easy as sending an email or text message.

Reporters have reached out to Ripple PayID Independent Reserve and BTC Markets alliance members for comment on the matter. But both declined to comment.
